[1] An application has been made for approval of an enterprise agreement known as the Environmental Industries Pty Ltd Enterprise Agreement 2015 (the Agreement). CaseChat Overview and Summary

Environmental Industries Pty Ltd was the subject of an application to the Fair Work Commission for approval of their Enterprise Agreement 2015. The application arose from negotiations between the employer and the employees' union. The legal issues that the Commission was required to address included whether the agreement met the statutory requirements for approval, whether the agreement provided for fair and reasonable terms and conditions of employment, and whether the agreement was made in good faith and without coercion. The Commission found that the agreement satisfied all the legal requirements for approval. It provided for fair and reasonable terms and conditions of employment, was made in good faith, and without coercion. The Commission also found that the agreement provided for appropriate mechanisms for the resolution of disputes between the parties. As a result, the Commission approved the Enterprise Agreement 2015. The employer and the union were directed to take all necessary steps to give effect to the approved agreement. The approval of the agreement ensures that the employees of Environmental Industries Pty Ltd have a fair and reasonable enterprise agreement that provides for their terms and conditions of employment.
