The Administrative Appeals Tribunal (AAT) considered an application by Emmario Pty Ltd concerning the nomination of a position under the Temporary Residence Transition stream. It was satisfied that the nomination application was compliant, that the nominator was actively and lawfully operating a business in Australia and had not met certain overseas business operation criteria in its most recent sponsorship approval. The Tribunal also found that the nominee's employment history met the specified duration and nature, and that the nominator had fulfilled its training commitments and complied with relevant obligations. Furthermore, no adverse information was known to the Department, and the nominator had a satisfactory record of compliance with workplace relations laws.

Consequently, the Tribunal set aside the original decision and substituted it with a decision approving the nomination.
