CaseChat Overview and Summary

This matter concerned an application by Mr Eleftheriou against the Australian Postal Corporation (Australia Post) before the Administrative Appeals Tribunal. Mr Eleftheriou, a postal delivery officer, claimed to have suffered a back injury arising out of or in the course of his employment, or alternatively, an aggravation of a pre-existing condition significantly contributed to by his employment. The dispute centred on whether Mr Eleftheriou's claimed back injury was work-related and whether his employment had significantly contributed to any incapacity for work.

The Tribunal was required to determine two primary legal issues: first, whether Mr Eleftheriou had suffered an injury arising out of or in the course of his employment with Australia Post; and second, whether he had suffered an aggravation of a pre-existing condition, where that aggravation was significantly contributed to by his employment, pursuant to section 5B of the relevant Act.

The Tribunal found the evidence before it to be conflicting, both in terms of the medical evidence and the accounts of the claimed incidents. It also expressed reservations about Mr Eleftheriou's credibility, noting that his explanations for not filing incident reports were unacceptable given his prior experience with workers' compensation claims. The Tribunal observed inconsistencies in the medical records regarding the localisation of Mr Eleftheriou's pain and noted that no quantitative assessment of his range of movement or neurological examination was performed. Furthermore, independent medical opinions indicated the presence of non-organic symptomatology. Despite his conviction that he was unable to work, the Tribunal noted that Mr Eleftheriou's described daily activities, including riding motorbikes, cycling, and maintaining properties, suggested he coped well with daily living.
