CaseChat Overview and Summary
The legal issues before the Commission were whether the agreement met the requirements for approval under the Fair Work Act 2009, including whether it provided for fair and reasonable terms and conditions of employment, and whether it was free from any improper conduct. The Commission also had to consider whether the agreement complied with the "better off overall test", which required that employees be no worse off financially under the new agreement than they would have been under their previous agreement.
The Commission found that the agreement met the requirements for approval. It found that the agreement provided for fair and reasonable terms and conditions of employment, and that it was free from any improper conduct. The Commission also found that the agreement met the better off overall test, as employees would be no worse off financially under the new agreement than they would have been under their previous agreement. The Commission approved the agreement, and it came into effect on 1 July 2016.
No further orders were made by the Commission.
