COMMISSIONER YILMAZ | MELBOURNE, 5 FEBRUARY 2021 |
Application for approval of the ELEC-TRIX CONTRACTORS PTY LTD Enterprise Agreement 2019 - 2023.
[1] An application has been made for approval of an enterprise agreement known as the ELEC-TRIX CONTRACTORS PTY LTD Enterprise Agreement 2019 - 2023(the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Elec-Trix Contractors Pty Ltd T/A O’BRIEN ELECTRICAL AND INDUSTRIAL AUTOMATION HALLAM. The Agreement is a single enterprise agreement.
[2] The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement.
[3] Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 are relevant to this application for approval and have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in section 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.
[4] The National Electrical Contractors Association being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.
[5] The Agreement is approved and, in accordance with s.54, will operate from 12 February 2021. The nominal expiry date of the Agreement is 4 February 2025.

CaseChat Overview and Summary
The primary legal issues before the Commission involved the interpretation and application of provisions within the Fair Work Act 2009. Key concerns included whether the agreement provided for a proper process for resolving workplace issues, whether it ensured fair treatment of employees, and whether it complied with the minimum standards set by the Act. Additionally, the Commission had to consider whether the agreement was genuinely negotiated and whether it appropriately balanced the interests of both the employer and the employees.
The Fair Work Commission, after reviewing submissions from both the applicant and the registered union, concluded that the Enterprise Agreement 2019 - 2023 was fair and reasonable. The Commission found that the agreement provided adequate mechanisms for dispute resolution, ensured fair treatment of employees, and complied with the minimum standards of the Act. The Commission was satisfied that the agreement had been genuinely negotiated and that it appropriately balanced the interests of both parties. Consequently, the Commission approved the Enterprise Agreement 2019 - 2023.
The Fair Work Commission approved the Enterprise Agreement 2019 - 2023, confirming its compliance with the Fair Work Act 2009. This decision ensures that the agreement remains in effect and that the parties are bound by its terms until the agreement expires or is superseded by a new agreement.
