Elder and Elder

In *Elder and Elder*, heard before Justice Mullane, the parties sought final property settlement orders. The dispute concerned the division of assets and liabilities, including child support obligations, a loan secured by a mortgage, and various other financial interests.

The court was required to determine the appropriate distribution of the parties' property and liabilities, including the allocation of child support payments, the resolution of a significant loan and its associated security, and the transfer of specific assets. The court also needed to address the potential for interest on outstanding payments and to make provision for the execution of necessary documents to give effect to its orders.

Justice Mullane ordered the husband to pay a lump sum for child support, which was to be credited against future administrative assessments. The wife was ordered to pay a sum to the husband by way of alteration of property interests, with an option to satisfy part of this obligation by paying the husband's child support liability and any arrears. The wife was also to be released from liability concerning a bank loan secured by a mortgage, while the husband was to transfer his interest in certain debts, shares, and a property to the wife. The orders stipulated that each party was to have no interest in the other's possessions, except as specified, and appointed the Registrar to execute documents if a party neglected to do so.
