The Administrative Appeals Tribunal considered an application for a Visitor (Class FA) visa, Subclass 600, made by a visa applicant who sought to visit family members in Australia. The review applicant, who is the visa applicant's uncle, sought to have the decision to refuse the visa affirmed. The central issue before the Tribunal was whether the visa applicant met the requirements of clause 600.211 of the Migration Regulations 1994, which mandates satisfaction that the applicant genuinely intends to stay temporarily in Australia for the purpose for which the visa is granted.
To determine if the visa applicant genuinely intended to stay temporarily, the Tribunal was required to consider whether the applicant had complied substantially with the conditions of any previous substantive or bridging visa, and whether the applicant intended to comply with the conditions of the Subclass 600 visa. The Tribunal noted that the visa applicant had no prior travel history to Australia and had never held an Australian visa, therefore, there was no evidence upon which to assess compliance with past visa conditions. The Tribunal also considered the applicant's intention to comply with conditions such as not working in Australia, not studying for more than three months, not being entitled to a substantive visa while remaining in Australia, and not remaining in Australia after the end of the permitted stay.
The Tribunal accepted that the visa applicant had family ties in Lebanon, including parents and siblings, and also had family members in Australia, specifically a married sister and his uncle, whom he wished to visit. The Tribunal acknowledged the applicant's desire to visit his sister whom he had not seen for four years and his uncle who had resided in Australia for fourteen years. However, despite these familial connections, the Tribunal was not satisfied that the visa applicant genuinely intended to stay temporarily in Australia for the purpose for which the visa was sought.
Consequently, the Tribunal found that the requirements of clause 600.211 were not met and affirmed the decision not to grant the visa applicant a Visitor (Class FA) visa.
