EKN (Administration)

In the case of EKN (Administration), the Guardianship and Administration Board reviewed the appointment of TFN as the administrator for his mother, EKN, who was unable to manage her affairs due to dementia. TFN, who was also the attorney for his father, had severed the joint tenancy of the property owned by EKN and her husband, resulting in a financial loss for EKN. The Board found that TFN had acted without reasonable care and had breached his duty as an administrator by failing to act in the best interests of EKN. The Board disallowed the severance of the joint tenancy and the payment of the sale proceeds into TFN's account, and held TFN personally liable for the disallowed expenditure. The Board appointed the Public Trustee as the new administrator and directed them to recover the disallowed expenditure from TFN. The Board also directed the new administrator to report the matter to the Police for potential criminal investigation into TFN's submission of a materially deficient annual report.
