Ekes v GHS Safety Products Australia Pty Limited (in liq)

The applicant, Ekes, sought leave to appeal from orders made by Rees J on 6 June 2019. The respondent was GHS Safety Products Australia Pty Limited (in liq). The application was before Payne JA in the Court of Appeal.

The primary legal issue before the Court was whether leave to appeal should be granted. Ancillary to this, the Court considered an application for an interim stay of the primary judge's orders.

Payne JA determined that the matter should be listed for a hearing of the application for leave to appeal. An interim stay of the orders made by Rees J was refused. The applicant was directed to inform the respondents of these orders.

The Court ordered that the application for leave to appeal be heard on 9 July 2019. Respondents wishing to participate were to file and serve evidence and submissions by 4pm on 8 July 2019. Liberty was granted to the parties to apply by email to the chambers of Payne JA.
