Eggleton (Migration)

The Administrative Appeals Tribunal (AAT) considered applications for Regional Employer Nomination (Permanent) (Class RN) visas, Subclass 187 (Regional Sponsored Migration Scheme), Direct Entry stream, for a position as a Dog Handler or Trainer. The core of the dispute concerned the approval of the nomination for this position.

The Tribunal was required to determine whether the nomination for the applicant's position as a Dog Handler or Trainer met the relevant criteria under the Migration Regulations. Specifically, the Tribunal had to assess the validity and approval of the nomination in relation to the visa application.

The Tribunal found that the nomination application was approved by the Tribunal itself. Applying the principles of administrative review, the Tribunal determined that the primary applicant met the criteria specified in clause 187.233(3) of Schedule 2 to the Regulations. Consequently, the Tribunal remitted the visa applications to the Minister for reconsideration of the remaining visa criteria.
