CaseChat Overview and Summary

The applicant, Eef19, sought judicial review of a decision made by the Immigration Assessment Authority (IAA). The applicant claimed to fear harm upon return to Bangladesh due to threats from the family of a former girlfriend, whose sister he alleged was killed in revenge. He also claimed fear of persecution from supporters of the Awami League due to his family's political affiliations. The IAA had considered new information, including newspaper articles and court documents indicating a criminal case lodged against the applicant in 2006, but was not satisfied of its credibility and found no exceptional circumstances to consider it. Ultimately, the IAA was not satisfied that the applicant's claims were credible, noting inconsistencies, and found that he did not meet the requirements for refugee or complementary protection.

The applicant raised two grounds for judicial review. First, he alleged a breach of procedural fairness under s 473CB of the *Migration Act 1958* (Cth), arguing he was not informed or invited to comment on any misunderstanding of his claims and was denied an opportunity to further explain them. Second, he alleged jurisdictional error, specifically a failure to take into account relevant considerations, asserting that the IAA adopted a rigid approach and failed to assess relevant and logically probative material.

Humphreys J reviewed the IAA's decision and the applicant's grounds for review. The Court found that while the applicant was unrepresented, it was unable to identify any jurisdictional error that had not been articulated by the applicant. Consequently, as none of the grounds of judicial review raised by the applicant demonstrated a jurisdictional error on the part of the IAA, the application was dismissed.
