Edmore & Anor and Bala

The applicants, Mr Edmore and Mr Wilkie, sought orders concerning the parental responsibility and living arrangements for their child, R Edmore-Wilkie. The matter came before Cronin J in the Federal Circuit Court of Australia.

The primary legal issues before the court were to determine the nature of parental responsibility for the child and to establish the child's primary residence. The court was also required to consider the implications of outstanding applications in light of the orders it would make.

His Honour ordered that Mr Edmore and Mr Wilkie have equal shared parental responsibility for the child. The court further ordered that the child live with the applicants. In addition, pursuant to sections 65DA(2) and 62B of the relevant legislation, the court directed that a Fact Sheet detailing the obligations created by the orders, the consequences of contravention, and information on assistance for compliance be attached to and form part of the orders. All other outstanding applications were dismissed.
