CaseChat Overview and Summary
The Court dismissed the application to set aside the bankruptcy notice and to restrain the respondent from presenting a creditors petition. The Court found that the notice, despite some irregularities, did not mislead the applicant as to his obligations. The applicant's argument that the notice did not specify the total amount of the judgment debt was rejected, as the Court held that the applicant, being a sophisticated businessman, would have been aware of his obligations under the relevant documents. The Court also held that the applicant's alleged confusion as to his indebtedness was not credible, given his professional legal advice and the clear terms of the documents.
The Court ordered that the application to set aside the bankruptcy notice be dismissed and that the application for an order restraining the respondent from presenting a creditors petition be dismissed.
