Dyson and Eggers

The case of Dyson and Eggers concerned a dispute between a husband and wife regarding the division of their property. The matter came before Foster J of the Family Court of Australia.

The court was required to determine the terms of property settlement between the parties, specifically concerning the transfer of interests in real estate, the discharge of a mortgage, and a monetary payment.

Foster J ordered that the husband transfer his interest in a property located at H Street, Town D, to the wife within three months. The wife was to indemnify the husband against mortgage instalments and, within three years, procure a discharge of the existing mortgage and register the transfer. The husband was also ordered to pay the wife $84,800 within two months. In the event of the husband's non-compliance, the Registrar of the Family Court was appointed to execute the necessary documents to give effect to the orders, including the transfer of the property and authorising the mortgage discharge. Liberty to apply was granted for implementation or enforcement.
