DWN066 v The Republic of Nauru

This matter concerned an appeal to the High Court of Australia between DWN066 (the appellant) and The Republic of Nauru (the respondent). The dispute arose from a decision of Justice Khan of the Supreme Court of Nauru made on 31 March 2017.

The High Court was required to determine whether to grant the appellant leave to file an amended notice of appeal and, upon such filing, to consider the appeal from the Supreme Court of Nauru's decision. The ultimate determination involved setting aside the Supreme Court's order and remitting the matter to the Refugee Status Review Tribunal.

By consent of the parties, the High Court ordered that the appellant be granted leave to file and serve an amended notice of appeal. Following the filing of this amended notice, the appeal was allowed, the order of Justice Khan of the Supreme Court of Nauru was set aside, and the matter was remitted to the Refugee Status Review Tribunal. The respondent was also ordered to pay the appellant's costs of the appeal to the High Court, fixed at $A7,835.
