Duckett and Duckett

In the matter of *Duckett and Duckett*, heard by Judge Betts, the dispute concerned parenting arrangements for a child, X, born in 2011. The court was required to determine the primary residence of the child and the terms of the child's time spent with each parent, in light of existing orders made on 28 March 2019.

The central legal issues before the court were the appropriate living arrangements for the child and the nature and frequency of contact between the child and the Mother. The court also considered the need for expert evidence regarding the Mother's mental health and its potential impact on parenting.

Judge Betts ordered that the child X is to live with the Father. The child is to spend time with the Mother as agreed in writing between the parents, or failing agreement, at Interrelate City A at a frequency and duration facilitated by that organisation. Both parents were directed to urgently attend Interrelate for intake procedures. The matter was adjourned for hearing directions, including potential trial directions, and the parties were ordered to confer with a view to obtaining a single expert psychiatrist's report on the Mother's mental health and its implications for future parenting arrangements.
