The Tribunal found that while it was probable the letter of 2 January 2013 was sent to Mr Drake, he did not recall its contents. However, his own statement that most correspondence from the Department said "basically the same things" suggested an awareness of his reporting obligations. The Tribunal was unable to find that the debt should be waived due to sole administrative error, nor could it identify special circumstances that made it desirable to waive the debt. Consequently, the Tribunal affirmed the decision under review.
