The grounds of appeal relate to the failure to consider the flood prone nature of the property and to the failure to consider the reduction in sales prices in the region. The Land Valuation Act 2010 requires the respondent to comply in its conduct with the requirements of the Act when undertaking various valuations required. The respondent's valuer relied on either vacant or lightly improved land sold in an open market albeit for properties which are located some distance from the subject property but within proximity to the town of Beaudesert. The appellant's valuer relied upon sales which are generally of improved properties in close proximity to the subject land, many of which sales occurred in what might be described as distressed circumstances. The appellant has also had to confront the difficulty that the report relied upon in Court was not really prepared for the purpose of a Court hearing. The Court finds that the appeal must be dismissed. The appeal is dismissed.
