The legal issues before the Commission were whether the agreement met the requirements of the Fair Work Act, including whether the agreement provided for a minimum rate of pay, included provisions for penalty rates and loadings, and was in the public interest. The Commission also had to consider whether the agreement was in line with the principles of enterprise bargaining and whether it provided for fair and reasonable terms and conditions of employment.
