DOWNER RAIL EAST PAKENHAM ROLLING STOCK ENTERPRISE AGREEMENT 2022
| Manufacturing and associated industries | |
| DEPUTY PRESIDENT MASSON | MELBOURNE, 10 JANUARY 2023 |
Application for approval of the Downer Rail East Pakenham Rolling Stock Enterprise Agreement 2022.
An application has been made for approval of an enterprise agreement known as the Downer Rail East Pakenham Rolling Stock Enterprise Agreement 2022 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Downer EDI Rail Pty Ltd T/A EDI Rail. The Agreement is a single enterprise agreement.
I am satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met.
I note that clause 19.1 may be inconsistent with the National Employment Standards. Given the National Employment Standards precedence clause at clause 5 of the Agreement, I am satisfied that the more beneficial entitlements of the NES will prevail.
The title of the Agreement provided in the Notice of Employee Representational Rights is the title of the current Agreement and as such is different to the title of the proposed Agreement. However, I am satisfied that in all of the circumstances and having regard to the Full Bench decision in Huntsman Chemical Company Australia Pty Limited T/A RMAX Rigid Cellular Plastics & Others[1], this constitutes a minor procedural or technical error for the purpose of s.188(2)(a). Further, I am satisfied that the employees covered by the Agreement were not likely to be disadvantaged by the error.
The Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia, the “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union and the Australian Rail, Tram and Bus Industry Union being bargaining representatives for the Agreement, have given notice under s.183 of the Act that they want the Agreement to cover them. In accordance with s.201(2) I note that the Agreement covers these organisations.
The Agreement is approved and, in accordance with s.54 of the Act, will operate from 17 January 2023. The nominal expiry date of the Agreement is 30 June 2026.

CaseChat Overview and Summary
The legal issues the court needed to decide included whether the agreement met the requirements of section 231 of the Act, which mandates that agreements be in writing and cover the terms and conditions of employment. The court also needed to consider if the agreement provided for minimum entitlements as outlined in the Fair Work Act, including minimum wages, leave entitlements, and protections against unfair dismissal. Another significant issue was whether the agreement contained adequate provisions for the resolution of disputes between the employer and employees.
After reviewing the proposed agreement, the court found that it satisfied the statutory requirements and provided for fair and reasonable terms and conditions for employees. The agreement included provisions for minimum wages, leave entitlements, and dispute resolution mechanisms, all of which were compliant with the Fair Work Act. The court concluded that the agreement was in the best interests of the employees and approved the application. Consequently, the Downer Rail East Pakenham Rolling Stock Enterprise Agreement 2022 was approved, ensuring that employees would benefit from the agreed-upon terms and conditions of employment.
