CaseChat Overview and Summary

The applicant, Dorset Council, applied to the Fair Work Commission for approval of its Enterprise Agreement 2018. The application was contested by the respondent, the Australian Services Union (ASU). The nature of the dispute involved the interpretation and compliance of the proposed agreement with the Fair Work Act 2009. The Fair Work Commission was the court responsible for adjudicating on this matter.

The legal issues before the Commission were whether the proposed agreement met the criteria for approval under section 231 of the Fair Work Act. Specifically, the Commission needed to determine if the agreement provided for the direct determination of employees' terms and conditions of employment, was free from prohibited content, and did not adversely affect the ability of employees to exercise their workplace rights. The Commission also considered whether the agreement had been subject to genuine bargaining and if it was in the best interests of the employees.

The Commission concluded that the proposed agreement met the statutory requirements for approval. It found that the agreement provided for the direct determination of employees' terms and conditions, contained no prohibited content, and did not unfavourably affect employees' rights. Furthermore, the Commission was satisfied that the agreement had been genuinely bargained and was in the best interests of the employees. The application was thus approved, and the Dorset Council Enterprise Agreement 2018 was registered. The Court ordered that the agreement be registered and that the applicant provide a copy of the registered agreement to the respondent within five business days.
