In the matter of PAC 1021 of 2021, Mr Doran was the applicant and Ms Doran was the respondent. The wife sought interim property orders concerning spousal maintenance and the sole use and occupation of the former matrimonial home.

The court was required to consider the applicable principles for making interim orders for spousal maintenance and the sole use and occupation of the former matrimonial home.

Foster J applied the relevant principles and made orders as sought by the wife. The husband was ordered to pay spousal maintenance of $45,000, representing $1,000 per week for 45 weeks, and thereafter $1,000 per week. The wife was granted sole use and occupation of the former matrimonial home. The husband was also restrained from making payments in a manner that would accrue income tax liability to the wife. Directions were given for written submissions regarding costs.
