Donaldson and Henderson

In the matter of *Donaldson and Henderson*, Kent J considered an application concerning the living arrangements and time spent with a child, C, born in April 2004. The dispute involved the Mother and the Father, with the court making orders regarding C's residence, time with the Father, and communication between C and the Father.

The court was required to determine the primary residence of the child, C, and the conditions attached to that residence. Further, the court needed to establish the arrangements for C to spend time with the Father, including the frequency and location of such time, as well as the nature of telephone contact between C and the Father.

Kent J ordered that C live with the Mother, subject to the condition that the Mother reside with her own mother, Ms L Donaldson. The court also ordered that C spend time with the Father on alternate weekends from Friday after school until Monday before school, provided this time was spent in Town 1. Additionally, the Mother was directed to allow C telephone contact with the Father on Tuesdays and Thursdays between 6:00 pm and 7:00 pm. The court also made directions regarding the filing of documents by the Father and the provision of a transcript of evidence, with costs reserved to trial.
