CaseChat Overview and Summary

Don Watson Pty Ltd sought approval of an enterprise agreement from the Fair Work Commission (FWC). The agreement, known as the Don Watson Long Distance Operations 2013 Agreement, was aimed at regulating employment terms and conditions for employees within the long distance operations division of the company. The applicant argued that the agreement met all legal requirements and was in the interests of the employees, while the respondents contended that the agreement did not adequately protect employee rights and was not in their best interests.

The court was required to determine whether the agreement complied with the Fair Work Act 2009 and whether it was in the best interests of the employees. This involved assessing whether the agreement was free from any prohibited content, whether it was appropriately certified, and whether it was made in good faith and on a proper basis. The court also had to consider the views of the employees and whether their rights and interests were adequately protected.

The FWC found that the agreement did not comply with the requirements of the Fair Work Act. Specifically, the court noted that certain provisions of the agreement did not meet the "better off overall test" as they did not provide employees with a fair and reasonable outcome compared to their previous conditions. The court also found that the agreement did not adequately address the interests of certain employee groups, particularly those in lower-paid positions. As a result, the application for approval was dismissed.

No final orders were made as the application was dismissed outright.
