Kirby J, dissenting, considered that the evidence did suggest a condition was intended. The legal principle applied was that for a gift to be subject to a condition subsequent, the intention to create such a condition must be clearly and unequivocally demonstrated.

The High Court ordered that the appeal be dismissed, upholding the decision of the Full Federal Court. This meant that ownership of "The Red Lady" remained with the Uniting Church of Australia Property Trust.
