CaseChat Overview and Summary
In DJC v Burg & Magistrates' Court of Victoria, the appellant, DJC, appealed against the dismissal of his application to quash the sentencing proceeding. DJC had been charged with 16 sexual offences against his four daughters and had pleaded guilty. The appellant contended that the magistrate who presided over the sentencing proceeding should not have done so because he was related to DJC and was therefore biased. The court was required to determine whether the magistrate’s conduct demonstrated bias that would warrant the quashing of the sentencing proceeding.
The court held that the magistrate’s comments to the complainants, when considered in conjunction with the other circumstances, did not provide a sound basis for a reasonable apprehension of bias. The magistrate’s remarks were made after DJC had pleaded guilty and were not grounds for an apprehension of bias. The court found no error in the judgment of Gillard, J. and dismissed the appeal. The court also noted that if the magistrate had indeed been biased, the appropriate course would have been to quash only the sentencing and not the convictions or the guilty plea, as these were not influenced by any alleged bias.
