CaseChat Overview and Summary

Diverse Fire Group Pty Ltd recently appeared before the Fair Work Commission in an application for the approval of the Diverse Fire Group Sprinkler Fitter Enterprise Agreement 2017-2020. The applicant sought to have the agreement, which was made between the company and the Australian Manufacturing Workers' Union, recognised as a registered agreement under the Fair Work Act 2009. The union argued that the agreement was made in good faith and that it provided fair and reasonable terms for the employees.

The primary legal issue before the Commission was whether the agreement met the criteria for approval under section 231 of the Fair Work Act. The Commission had to consider whether the agreement was made in good faith, whether it provided for the full protection of employees, and whether it included provisions for the determination of wages and other conditions of employment. The Commission also had to ensure that the agreement did not discriminate against any particular group of employees or contravene any other provisions of the Act.

After hearing submissions from both parties, the Commission found that the agreement met the criteria for approval. The Commission noted that the agreement provided for fair and reasonable terms for the employees, including provisions for the determination of wages and other conditions of employment. The Commission also found that the agreement was made in good faith and did not discriminate against any particular group of employees. The Commission approved the agreement, which will now be registered under the Fair Work Act.

The Fair Work Commission approved the Diverse Fire Group Sprinkler Fitter Enterprise Agreement 2017-2020, finding that it met the criteria for approval under the Fair Work Act. The agreement provides for fair and reasonable terms for the employees and was made in good faith. The Commission's decision ensures that the employees will have their rights and conditions of employment protected under the registered agreement.
