CaseChat Overview and Summary
The central legal issues for the Commission to consider were whether the proposed agreement provided for a safety net of minimum wages and conditions, ensured that employees had a genuine opportunity to be represented by an independent trade union, and that the agreement was not contrary to public policy. The Commission also needed to assess whether the agreement had been made in good faith and whether the bargaining process was genuine.
The Commission found that the proposed agreement met the legislative criteria for approval. It provided for a safety net of minimum wages and conditions, offered employees a genuine opportunity to be represented by an independent trade union, and did not contravene public policy. Furthermore, the Commission was satisfied that the agreement had been made in good faith and that the bargaining process was genuine. Consequently, the Commission approved the Ditchfield Contracting Enterprise Agreement 2015-2019.
