The court reasoned that the failure to serve the brief within time meant that the evidence could not be admitted, and that the Magistrate did not have the power to extend time for the hearing in these circumstances. The court found that the Magistrate's order admitting the evidence and granting an extension was therefore erroneous.

Consequently, the Court of Appeal quashed the Magistrate's order and remitted the matter to the Local Court for further hearing according to law.
