Director of Public Prosecutions v King [2024] TASCCA 8 [2024] TASCCA 8 15 August 2024

CaseChat Overview and Summary

The Director of Public Prosecutions appealed against the sentence imposed on the respondent, King, who had instigated and abetted the setting of fires at two separate properties on successive nights. The properties, which included residential and business premises, were owned by individuals against whom the respondent harboured a grudge. The fires caused approximately $588,000 in damage, and the victims expressed concerns for their safety. The appeal was heard by Estcourt and Pearce JJ and Porter AJ.

The central legal issue before the court was whether the sentence of 16 months' home detention coupled with an order for 50 hours of community service was manifestly inadequate, given the gravity of the offences and the respondent's personal circumstances. The court was required to consider the impact of the respondent's diagnosed mental illnesses, which had a causative connection to the offending and affected considerations of imprisonment, alongside other mitigating personal circumstances and factors.

The court reasoned that while the respondent's mental illnesses and other mitigating factors were relevant, they did not justify a sentence that failed to adequately reflect the seriousness of the criminal conduct. The deliberate and repeated nature of the arson, the significant financial damage, and the fear instilled in the victims weighed heavily against a non-custodial sentence. The court found that the original sentence was so lenient as to be outside the bounds of any reasonable exercise of sentencing discretion, particularly in light of the need for general deterrence and denunciation of such serious offences.

Consequently, the court allowed the Crown's appeal and resentenced the respondent.
