The parties to this proceeding were the Director-General, Department of Communities, Child Safety and Disability Services (the Applicant) and Mr Taare (the Respondent Father), concerning the child Y. The dispute involved an application for injunctive relief to prevent the child's removal from Australia and to maintain his usual place of residence. The matter came before Kent J of the Family Court of Australia.

The primary legal issues before the court were whether to grant injunctions restraining the Respondent Father from removing the child Y from the Commonwealth of Australia and from changing the child's usual day-to-day residence. The court was also required to consider the placement of the Respondent Father and the child on the Family Law Watch List and the surrender of passports.

Kent J granted the injunctions sought by the Applicant. The court ordered that the Respondent Father be restrained from removing, or attempting to remove, the child Y from Australia and from changing the child's usual place of residence. The court also ordered that the names of the Respondent Father and the child be placed on the Family Law Watch List for two years, and that the Respondent Father surrender all current passports relating to himself and the child. The court further directed that the Marshal of the Family Court, the Commissioner and federal agents of the Australian Federal Police, and officers of state and territory police forces were empowered to take all necessary steps to give effect to these orders. The court also made directions regarding the filing of documents and set the matter down for a hearing.
