DIRECTOR-GENERAL, DEPARTMENT OF COMMUNITIES, CHILD SAFETY AND DISABILITY SERVICES & FARAH ( NO 2)

The Director-General of the Department of Communities, Child Safety and Disability Services brought proceedings against Mr Farah concerning his child, B. The dispute involved concerns for the child's safety and welfare, leading to an application for protective orders. The matter was heard by Kent J in the Family Court of Australia.

The court was required to determine whether to grant interim orders to protect the child, B, from potential harm or risk of abduction. Specifically, the court considered the necessity of restraining the Respondent Father from removing the child from Queensland or from his usual place of residence, and whether to order the surrender of passports.

Kent J ordered that the Respondent Father surrender all current passports relating to himself and the child, B, to an officer of the Department of Communities, Child Safety and Disability Services. Furthermore, an injunction was issued restraining the Respondent Father from changing the child's usual day-to-day residence from their current premises. The proceedings were listed for a further mention on 23 March 2015.
