Director-General, Department of Communities, Child Safety and Disability Services and Sakopo

The Director-General of the Department of Communities, Child Safety and Disability Services (the Applicant) sought orders against Sakopo (the Respondent) in the Supreme Court of Queensland. The dispute concerned the Applicant's application for orders relating to the father and T, born in April 1997, which the Respondent sought to have dismissed.

The central legal issue before Kent J was whether the Applicant had established grounds for the orders it sought, and consequently, whether the application should be dismissed. This involved an assessment of the evidence presented by the Applicant in support of its application.

Kent J discharged paragraphs 1 to 7 of the orders made on 23 March 2012. The court ordered the Applicant to return all current passports relating to the Father and T to the Respondent. Furthermore, the Applicant was directed to notify the Australian Federal Police of these orders and was granted liberty to serve them upon the Australian Federal Police. The application filed by the Director-General on 12 March 2012 was dismissed, and the proceedings were removed from the pending cases list.
