CaseChat Overview and Summary

This matter concerned an application for a Partner (Temporary) (Class UK) visa, Subclass 820 (Spouse), before the Tribunal. The central issue was whether the applicant met Public Interest Criterion (PIC) 4020, which requires that no bogus documents or materially false or misleading information be provided in relation to the visa application or a previous visa held within 12 months. The Tribunal was also required to consider whether the applicant had been refused a visa due to a failure to satisfy PIC 4020(1) or (2A) within specified periods, subject to certain exceptions for applicants under 18.

The Tribunal was tasked with determining if the applicant had provided a bogus document or information that was false or misleading in a material particular. The definition of "bogus document" under s.5(1) of the Migration Act 1958 was contrasted with the definition of "information that is false or misleading in a material particular" under PIC 4020(5), noting that the former does not require the false or misleading statement to be relevant to a visa grant criterion. The Tribunal also considered that PIC 4020(1) and (2) apply regardless of whether the Minister became aware of the issue through information provided by the applicant, and whether the document or information was provided knowingly or unwittingly.

The Tribunal found that the applicant and their partner were validly married, shared a mutual commitment to a shared life to the exclusion of all others, and that their relationship was genuine and continuing. Furthermore, the Tribunal was satisfied that the parties lived together and were not living separately and apart on a permanent basis. Consequently, the Tribunal remitted the application for reconsideration with a direction that the applicant met the criteria for the Subclass 820 visa, including PIC 4020.
