Dib v MIMA involved an application for judicial review of the refusal to extend a 686 tourist (long stay) visitor visa, which contained a mandatory condition that the holder not engage in any work in Australia. The Court found that the Tribunal had indeed erred in its interpretation of the term "work" and in its analysis of the applicant's future intentions. The Court held that the Tribunal had failed to consider the relevant factors in determining whether the applicant's activities constituted "work", such as the applicant's sense of moral obligation towards his family and his purely compassionate and domestic motives. Furthermore, the Court disagreed with the Tribunal's finding that the applicant would engage in work if his visa was extended, as the applicant's expressed intention to work if granted permission did not logically show that he would breach his visa conditions to achieve his wider desires. The Court also found that the Tribunal's finding that the applicant had already breached the condition of his current visa that he not work was an unnecessary finding which operated to the applicant's detriment without ever being the subject of the application to the Tribunal. As a result, the Court set aside the decision of the Tribunal and remitted the matter to the Tribunal for redetermination according to these reasons for judgment, and ordered that the costs of the applicant be paid by the respondent.
