CaseChat Overview and Summary

In the matter of DHL Express (Australia) Pty Limited, the Fair Work Commission was asked to decide on the approval of the DHL Express NSW Operations Agent Enterprise Agreement 2013. The dispute arose between DHL Express (Australia) Pty Limited and the Communication, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (the union). The union sought to have the agreement approved under the Fair Work Act 2009, asserting that it met the requirements for being a “low paid” enterprise agreement and thus eligible for the simplified agreement-making process. DHL Express contested the union's claim that the agreement was for low-paid employees and argued that the agreement did not meet the necessary criteria.

The central legal issue before the commission was whether the agreement constituted a "low paid" enterprise agreement as defined under the Fair Work Act. This required the court to consider the definition of low-paid employees and whether the majority of employees covered by the agreement fell within this category. Additionally, the commission had to determine whether the agreement met all the procedural and substantive requirements for approval under the Act.

In examining the evidence, the commission found that a significant proportion of employees covered by the agreement were indeed low-paid, satisfying the definition under the Act. The commission also considered the procedural fairness of the agreement-making process and found that it complied with the necessary legal standards. The substantive terms of the agreement were deemed to be reasonable and in line with the principles of the Fair Work Act. Consequently, the commission approved the agreement, acknowledging its compliance with all statutory requirements.

As a result of the commission's decision, the DHL Express NSW Operations Agent Enterprise Agreement 2013 was approved and is now in effect. This decision ensures that the terms and conditions of employment for the employees covered by the agreement are legally recognised and enforceable.
