CaseChat Overview and Summary
The Fair Work Commission considered various aspects of the case, including the nature of Ms. Habets' employment, the circumstances leading to her dismissal, and the respondent's justification for the termination. The court examined the procedural fairness of the dismissal process and whether the respondent had followed appropriate protocols. Additionally, the Commission evaluated the substantive fairness of the dismissal, focusing on whether the termination was a reasonable management action in the given circumstances.
In its reasoning, the Fair Work Commission concluded that Ms. Habets' dismissal was indeed unfair. The court found that the respondent did not adequately address the issues leading to the termination and did not provide Ms. Habets with an opportunity to respond to the allegations against her. Furthermore, the Commission determined that the dismissal was not a reasonable management action given the circumstances. As a result, the Commission ordered that Ms. Habets be reinstated to her position and that she be compensated for the period of her unjustified dismissal.
