Delany and Delany

In the matter of *Delany and Delany*, Rees J of the Family Court of Australia made orders concerning the time the children B and C would spend with their parents. The dispute concerned the arrangements for the children's time with their father.

The court was required to determine the specific arrangements for the children's time with their father, including weekend and mid-week contact, as well as time during school holidays. The court also needed to ensure that the orders complied with the requirements of the *Family Law Act 1975* (Cth) regarding the particulars of obligations and consequences of contravention.

Rees J ordered that pending further order, the children would spend time with their father on alternate weekends from Friday after school until Monday morning (or Tuesday morning if it was a long weekend), commencing 26 August 2016. Additionally, the children were to spend time with their father each Wednesday from after school until before school on Thursday, commencing 24 August 2016. Time during school holidays and in accordance with existing orders was also stipulated. The court also ordered that the children spend time with their mother as per existing orders. Pursuant to ss 65DA(2) and 62B of the *Family Law Act 1975* (Cth), the particulars of the obligations, consequences of contravention, and assistance available were to be set out in an attached Fact Sheet, which was incorporated into the orders.
