The court noted the child's excellent relationship with both parents, as evidenced by expert reports, and acknowledged the mother's significant stress and anxiety related to the father's increased involvement and the litigation process. Despite the mother's difficulties, the court found merit in the father's proposal for the Thursday overnight contact, reasoning that it would reduce face-to-face contact between the parents, allow the father to arrange activities without time constraints, and facilitate the development of special activities between father and son. The court also considered the father's willingness to facilitate the child's relationship with the mother, noting that the mother's capacity to encourage a greater relationship with the father was limited by her adjustment to the existing regime.

The court ordered that the previous consent orders be discharged and new orders made by consent, as per minutes to be provided by the mother's solicitors. Specifically, the father was to spend time with the child overnight from after school on each other Thursday until the commencement of school on the Friday morning. The father was also permitted to attend extracurricular and school-related events under specific conditions. The father was ordered to pay $950.40 towards the costs incurred by Ms D for attending court and $7500 towards the mother's costs of the application, with all other applications and responses dismissed.
