Deb v MIBP

Deb (the applicant) sought judicial review of a decision made by the Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs (the Minister) to refuse to grant her a visa. The applicant was a citizen of Vietnam and had applied for a partner visa (subclass 820) on 15 March 2019. The Minister's delegate refused the application on 20 August 2020, finding that the applicant had not satisfied the criteria under Schedule 1 of the Migration Regulations 1994 (Cth) and Regulation 1.12(1) of the Migration Regulations 1994 (Cth) because she had not provided a valid application. The applicant sought review of this decision in the Federal Circuit Court of Australia.

The primary legal issue before the Court was whether the applicant had made a valid application for a partner visa. Specifically, the Court had to determine whether the applicant had provided the required documentation at the time of lodging her application, as stipulated by Schedule 1 of the Migration Regulations 1994 (Cth). The Minister's delegate had concluded that the application was invalid due to the absence of certain prescribed documents, rendering the applicant ineligible for the visa.

Judge Nicholls found that the applicant had indeed failed to provide the necessary documents at the time of lodging her application, as required by Schedule 1 of the Migration Regulations 1994 (Cth). The Court applied the principles of administrative law, emphasising the importance of compliance with legislative requirements for the validity of visa applications. The delegate's decision was found to be correct in its application of the law to the facts.

Consequently, the Court dismissed the application for judicial review.
