De Zobra and De Zobra

In the matter of *De Zobra and De Zobra*, Dessau J of the Family Court of Australia considered an application for contravention of parenting orders and a related application to vary those orders. The wife was alleged to have contravened orders made on 16 October 2009 concerning the children's time with the husband.

The primary legal issues before the court were whether the wife had contravened the parenting orders as alleged, and if so, whether a contravention had occurred. The court was also required to determine whether to vary the existing parenting orders in light of the circumstances that had arisen.

Dessau J found that the contravention alleged by the husband was proven against the wife. However, the court determined that no penalty would be imposed for this contravention. The court also varied paragraph 4(a) of the original parenting orders, specifying that the husband would have the children on alternate weekends from the conclusion of school on Friday, or 7:00 pm if extracurricular activities extended beyond school, until 6:30 pm on Saturday, commencing from 13 November 2009.
