CaseChat Overview and Summary

In the Family Court of Australia at Melbourne, Justice Cronin presided over proceedings between Ms Dawkins (the applicant mother) and Mr Boreham (the respondent father) concerning parenting orders for their daughter, born in October 2005. The mother sought a review of orders made by a Senior Registrar on 12 January 2007, primarily due to issues she alleged had arisen since that time. The proceedings involved significant affidavit material, with over 42 documents filed, much of which was repetitive.

The court was required to determine the appropriate interim parenting arrangements for the child, considering the parties' contentious relationship, allegations of alcohol abuse and aggression by the father, and the mother's significant care responsibilities for an older daughter with a serious neurological disorder. Key legal issues included the father's access to the child, restrictions on his behaviour, and the management of future proceedings, particularly in light of expert reports to be obtained. The court also had to consider the presumption of equal shared parental responsibility, which was agreed to be inapplicable in this case due to the proceedings' background.

Justice Cronin reasoned that, given the limited time the father had previously spent with the child and the serious nature of the allegations made by both parties, he would not order extended periods of time at this stage. He noted the poor relationship between the parties, including allegations of physical and verbal abuse, and expressed concern about the disputes occurring during child handovers. To address this, the court ordered that the father spend time with the child on Thursdays and Saturdays from 10:00 am to 4:00 pm, with handovers to occur at a designated centre. The court also mandated the use of a communication book for medical and dietary information and requested the matter be judge-managed by Justice Cronin, with liberty to apply on short notice for specific issues, including the implementation of expert recommendations and adjustments to time between father and child pending final orders.

The court discharged specific paragraphs of the previous orders and dismissed all interim applications, referring the substantive applications to the Trial Notice List. The orders included a fact sheet detailing obligations and consequences of contravention, pursuant to sections 65DA(2) and 62B of the Family Law Act 1975 (Cth).
