Davidovic and Davidovic

In the matter of *Davidovic and Davidovic*, heard by McClelland DCJ, the dispute concerned orders relating to children. The Independent Children’s Lawyer had proposed a Minute of Orders, which the Court considered in its determination.

The primary legal issue before the Court was the determination of appropriate orders concerning the children, taking into account the proposed Minute of Orders from the Independent Children’s Lawyer. The Court also had to consider the scheduling of future proceedings, including the vacating of a listing and the setting of a new hearing date.

McClelland DCJ made orders in accordance with the Minute of Orders proposed by the Independent Children’s Lawyer, with the exception of a specific proposed order numbered 8. The Court vacated the listing before Senior Registrar Campbell on 11 May 2020. The Application in a Case filed by the father on 7 January 2020 was listed for hearing before Deputy Chief Justice McClelland on 11 August 2020, contingent upon the availability of a single expert report from Dr C. The father was granted liberty to apply for an earlier listing, provided at least 48 hours' notice was given to the Court and the other parties, upon receipt of Dr C's report.
