CaseChat Overview and Summary
The legal issues that the Commission was required to determine included whether the agreement provided for the terms and conditions of employment of the employees covered by the agreement; whether it was in writing and had been made by the employer and an organisation representing the employees; and whether it met the requirements of section 230 of the Act. The Commission also needed to determine whether the agreement provided for a proper process for the resolution of any disputes that may arise under the agreement.
The Commission found that the agreement met all of the requirements of the Act and was in the best interests of the employees. The agreement provided for the terms and conditions of employment of the employees covered by the agreement, and was in writing and had been made by the employer and an organisation representing the employees. The agreement also provided for a proper process for the resolution of any disputes that may arise under the agreement. The Commission was satisfied that the agreement was fair and reasonable, and approved it under section 236 of the Act. The agreement is now registered and is binding on the parties from the date of registration.
