DALLAL & HANIF

The parties, Mr. Dallal (husband) and Ms. Hanif (wife), were involved in a contested application for divorce. The wife had been residing in India since March 2018. The husband contended that he had disclosed his intention to divorce in January 2019, and that the parties had not subsequently reconciled. The wife challenged the jurisdiction of the Australian court to hear the matter.

The central legal issues before the court were whether the husband had unequivocally communicated his intention to divorce the wife in January 2019, and whether any reconciliation had occurred between the parties thereafter. The court was also required to determine whether it possessed the necessary jurisdiction to grant the divorce.

Burchardt J found that text messages exchanged between the parties in January 2019 were clear and unequivocal in their expression of the husband's intention to divorce. The court further determined that the wife's subsequent messages did not demonstrate an unequivocal intention to reconcile. Consequently, the wife's challenge to the court's jurisdiction was not upheld.

The court ordered that the divorce be granted.
