DA SILVA & DUARTE

In the matter of *DA SILVA & DUARTE*, Ainslie-Wallace J of the Family Court of Australia determined issues concerning the parental responsibility and living arrangements for a child. The dispute involved the mother and father of the child, B, born in 2005.

The court was required to determine who should have sole parental responsibility for the child and with whom the child should live. Additionally, the court needed to make orders regarding the time the child would spend with the father.

Ainslie-Wallace J ordered that the mother have sole parental responsibility for the child and that the child live with the mother. The court further ordered that the child spend time with the father as agreed between the parties in writing.
