Cull & Lenz (No. 6)

In the matter of SYC 6598 of 2017, Mr Dea (the applicant) sought costs orders against Ms Cull and Mr Lenz (the respondents) following an application determined on 19 March 2021. The court, presided over by Rees J, was required to make orders regarding the payment of these costs.

The central legal issue before the court was the allocation of costs associated with the application heard on 19 March 2021. Specifically, the court needed to determine how much each party should contribute towards the legal expenses incurred.

Rees J ordered that, from the proceeds of the sale of the property at EE Street, Suburb FF, the trustee for sale was to pay $12,000 to Mr Dea for the costs of the application. Additionally, the court ordered that the wife pay the husband the sum of $5,000, also for the costs of the application, to be paid from any funds to which the wife was entitled in the substantive proceedings.
