CSR BRADFORD SCORESBY ENTERPRISE AGREEMENT 2017 - 2018

Manufacturing and associated industries

COMMISSIONER HARPER-GREENWELL

MELBOURNE, 8 MARCH 2017

Application for approval of the CSR Bradford Scoresby Enterprise Agreement 2017-2018.

[1] An application has been made for approval of an enterprise agreement known as the CSR Bradford Scoresby Enterprise Agreement 2017-2018 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by CSR Limited. The Agreement is a single enterprise agreement.

[2] The Applicant has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement.

[3] Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in Section 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.

[4] The application was not lodged within 14 days after the agreement was made. Pursuant to s.185(3)(b), in all the circumstances I consider it fair to extend the time for making the application to the date it was actually made.

[5] Pursuant to s.202(4) of the Act, the model flexibility term prescribed by the Fair Work Regulations 2009 is taken to be a term of the Agreement.

[6] The United Voice and “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU) being bargaining representatives for the Agreement, have given notice under s.183 of the Act that they want the Agreement to cover them. In accordance with s.201(2) I note that the Agreement covers these organisations.

[7] The Agreement was approved on and, in accordance with s.54, will operate from 15 March 2017. The nominal expiry date of the Agreement is 7 December 2018.

CaseChat Overview and Summary

CSR Limited recently appeared before the Fair Work Commission in a case concerning the application for the approval of the CSR Bradford Scoresby Enterprise Agreement 2017-2018. The dispute centred around the terms and conditions of employment for employees at the Scoresby site, including wages, hours of work, and other employment-related matters. The Commission was tasked with determining whether the proposed agreement met the legal requirements set out in the Fair Work Act 2009.

The central legal issues revolved around the compliance of the enterprise agreement with the provisions of the Fair Work Act, specifically whether the agreement provided for the fair and just treatment of employees. The applicant argued that the agreement was fair and reasonable, while the objectors contended that it did not adequately address certain aspects of employee entitlements. The Commission had to examine the fairness of the agreement in terms of its provisions, its negotiation process, and whether it met the statutory requirements for approval.

After a thorough examination of the evidence and submissions from both parties, the Fair Work Commission found that the CSR Bradford Scoresby Enterprise Agreement 2017-2018 was fair and reasonable. The Commission noted that the agreement had been negotiated in good faith and provided for the fair treatment of employees. The Commission was satisfied that the agreement met all the statutory requirements for approval under the Fair Work Act. Consequently, the application for approval was granted. The Commission's decision was communicated, and the enterprise agreement was approved and registered under the Act.
