The Court found that the applicant's claims of harm in custody were not entirely contiguous with his claims of harm in the community based on his race, failed asylum seeker status, or imputed political opinion. Therefore, the Tribunal erred by failing to consider integers of the applicant's claim that he could suffer harm from other inmates or guards for reasons unrelated to his previous claims, or that as a Tamil, he faced a greater risk of mistreatment while on remand.

The application for review was dismissed.
