CaseChat Overview and Summary

Credit Union Australia Limited, trading as CUA, applied to the Fair Work Commission for approval of its Enterprise Agreement 2017. The dispute centred on the terms and conditions of employment for CUA's staff, as well as broader issues such as wage rates, working conditions, and dispute resolution mechanisms. The Commission was tasked with determining whether the agreement met the legal requirements for approval and whether it provided for fair and reasonable terms and conditions for the employees.

The central legal issues before the Commission involved assessing whether the agreement contained mandatory terms as prescribed by the Fair Work Act 2009 and whether it complied with the "better off overall test." This test requires that employees be no worse off financially and at least as well off in other respects under the new agreement compared to their previous conditions. The Commission also needed to consider whether the agreement provided for fair and reasonable terms and conditions, including whether it met the minimum entitlements set out in the National Employment Standards.

In its decision, the Commission found that the CUA Enterprise Agreement 2017 met the statutory requirements for approval. The agreement was deemed to be in the public interest, as it was considered to be fair and reasonable for both the employees and the employer. The Commission noted that the agreement provided for minimum wage rates and conditions that were consistent with or better than those provided by the National Employment Standards. The better off overall test was satisfied, as employees were not disadvantaged financially or in other respects by the terms of the agreement. Consequently, the Commission approved the enterprise agreement, deeming it compliant with the necessary legislative provisions.

The final orders of the Commission were that the CUA Enterprise Agreement 2017 be approved and registered, effective from the date of the decision. This approval ensures that the agreement will govern the employment terms and conditions of CUA's staff, subject to any subsequent amendments or terminations in accordance with the Fair Work Act 2009.
